Divorce may be freely utilized today as a way to end a marriage but in truth, it’s the last stage in the dissolution of marriage. Divorce, as i’ve already explained, terminates the marriage and the legal duties and responsibilities which a couple has for each other. It cancels the marital status of the parties involved and enables them to get married again should they wish. It is far easier to get a divorce in the usa than say annulment. This is the reason many people would certainly settle for this than move through the rougher battle of having an annulment. Really the only tough thing with this procedure is when it calls for child custody. More often than not, the battle for custody is what makes the process hard.
An annulment, however, declares the marriage null and void. In affirming this, the marriage is going to be declared to have not taken place at all! Generally, the terms that can make an annulment possible are harder like for instance, getting married when you are underage and there’s no consent from the parents for the marriage or if the marriage took place under false pretenses. Usually, these conditions involve falsehoods, non-declaration of legal commitments or not staying with the legal terms of marriage.
Legal separation can be considered as a notch lower than divorce when it comes to removing all legal obligations and duties. It is nevertheless harder to get one. In legal separation, the couple agrees to reside apart but will continue to support one another and also have legal commitments to each other. Just like married couples, their properties continue to be bound together. Also, they are not permitted to marry another person except if they have a divorce or an annulment.
But for many individuals, there is really no requirement for these legal commitments to continue. Therefore, most Americans choose divorce. One cannot really blame them. It’s easier and faster with less the hassle.
